Terms and Conditions

1. Acceptance Of Terms

Using Nexora Hosts’ services, or signing a management agreement with us, means you agree to these Terms and Conditions. If you do not agree, stop using our services. We may revise these terms later. Some updates are small. For example, we may fix spelling, restate a term, or reflect changes in law. When we make a small change, it starts when we put it on our website.

Other updates are not small. A change is material if it changes your fees, your duties, or your rights under this agreement. For those, we will send you at least 30 days of written notice. If you keep using the services after a change takes effect, you are agreeing to the change. If you do not accept a material change, you can end the agreement during the notice time.

2. Description OF Services

Nexora Hosts supports vacation rental owners in California. We take care of the routine tasks. That way, you can focus on your life instead. We set up your listings and keep improving them on multiple rental sites. We also use pricing that changes as time goes on.

When guests reach out, we respond and guide them. We also check who is booking before they arrive. After checkout, we coordinate the cleaning team so the place is ready on time. If something needs a fix, we arrange repairs and handle other needed upkeep.

Your calendar stays in sync. You do not have to worry about double bookings or wrong dates. We also manage reviews and watch the results. You can see what is working and what is not. We can run your rental on Airbnb, Vrbo, Booking.com, Expedia, and other sites you approve of.

We charge a management fee based on a share of your monthly rental revenue. Platform fees are subtracted first. The rate for your property is written in your management agreement. Our aim is higher income for your home. We also want guests to have a good stay and the day-to-day work to run without issues.

What we do for your property is described in your management agreement.

3. Property Owner Responsibilities

If you own the property and use Nexora Hosts, you agree to the points below.

  • Keep the home safe, clean, and ready to live in. Follow all rules on the platform and all local laws.
  • Provide accurate information about the place. Post true photos. Write a description that matches what guests will find.
  • Get the permits, licenses, and insurance you need. Keep them current while the property is listed.
  • Follow every local short-term rental rule. This can include zoning laws and any HOA rules.
  • Allow Nexora Hosts fair access to the property. This is for photos, checks, repair planning, and guest check-in. You will get at least 24 hours’ notice before someone enters. If there is an emergency tied to guest safety, property security, or the home’s condition, we will reach you as soon as we can after.
  • Respond fast to urgent issues. If a problem could affect guest safety or comfort, fix it right away.
  • Allow Nexora Hosts to reach out to guests and other parties for you. This may include booking sites and service providers.

4. Guest Relations And Liability

Nexora Hosts supports guest messages, calendars, and coordination. You still carry the property risk. So you are on the hook for injuries, damage to the home, and guest disputes that come up during a stay. We screen guests and use the booking rules. Still, we cannot guarantee how each person will behave. Please keep the right liability coverage.

If your agreement covers damage claim handling, we will manage the paperwork. That includes preparing, submitting, and checking in on the claim through the platform, the insurance company, or the guest. We will share updates as things move forward. Filing a claim for you does not mean we control the result. It also does not create responsibility for any loss that the claim does not cover.

Outside of the claim handling we just described, Nexora Hosts is not responsible for harm, theft, accidents, or other problems caused by guests. We assist with cleaning setup and normal upkeep. If there is a failure such as damage to the structure, an unexpected repair, or a safety issue, that is your job to fix. Keep your homeowner or landlord policy active. Pick coverage that includes short-term rentals

5. Payment Terms And Fees

When you sign the management agreement, you agree to pay Nexora Hosts a management fee. The fee is based on a share of your monthly rental income. Platform fees are taken out first. The exact percentage comes from your management agreement.

Each month, the fee comes out of what you are paid. We do not send a separate invoice for it, and there is no single due date you must track. Your payout is worked out from your total booking income. Then we subtract platform charges, cleaning costs, and the management fee. We pay out on a regular monthly schedule. Your monthly statement lists each part clearly. You will not see surprise charges or end-of-month takebacks.

If a month comes in where your booking income does not cover cleaning costs, third-party charges, and the management fee, you must cover the missing amount. We will show the shortfall on your statement and bill it as a separate invoice. If that invoice is still unpaid after more than 30 days, we may stop providing management services until the balance is cleared.

There are no refunds for management services that have already been delivered. Management is ongoing.

6. Cancellation And Termination

Either party can stop this agreement by sending written notice at least 30 days ahead. While the notice period is running, we continue the normal management work. This helps the handover stay smooth. If a guest booking was already confirmed before the end date, we will manage it until checkout. The management fee still applies for that booking.

After the end date, Nexora Hosts will return your listings to you. Then we will send your final account statement. If there is any unpaid balance, it must be paid before we give back full control.

When the agreement is over, you need to make sure your property still follows the platform rules. You also need to follow the laws in your area.

7. Intellectual Property And Content

Content from Nexora Hosts, like listing text, photos, price options, and ad copy, is our own property. If we decide to change that, we must state it in writing. You keep ownership of your own home and any personal details you send us.

If our deal ends, you can still use the listing text and the photos we made for your property. This right lasts forever. It is free of royalties and not exclusive. You can use it on any site while you own the property. This permission is only for your property. It does not cover reselling the content, sharing it with others for use, or using it for another property. We can also keep using the same materials in our own portfolio and ads.

You allow us to use photos of your property. You also allow us to use any review or testimonial you give us to promote our services. If you tell us to end this, we will stop. We will also remove the materials from our current marketing in up to 30 days.

You cannot copy, repost, or claim authorship for content made by our team. This is only allowed within the permission stated above. Booking details and guest info are handled under our Privacy Policy.

8. Limitations Of Liability

Nexora Hosts runs this service on an as-is basis. We do not promise the following:

  • You will get a certain number of bookings.
  • Guests will be happy with every stay.
  • Your revenue will match any specific amount.

Results can shift based on market conditions, the time of year, and wider economic changes. These things are not within our control.

If a claim happens, our maximum responsibility is capped at the management fees you paid in the month the claim is tied to. We are not responsible for lost profits, guest complaints, harm to property, losses from storms, floods, or other events from nature. We also do not take responsibility for outages or disruptions on the platform.

If delays occur due to third-party sites, payment processors, or other service providers, that is not our fault. You agree to accept the normal risks that come with operating a short-term rental.

Nothing in this section is meant to reduce or remove our liability for fraud, gross negligence, intentional wrongdoing, or any other matter that cannot be limited or excluded under California law. This includes the rule in California Civil Code section 1668.

9. DISPUTE RESOLUTION

If a problem comes up under this agreement, the two sides will try to sort it out by talking in good faith first. If they cannot reach a resolution within 14 days, either side may ask for mediation or move forward with a court case.

This agreement will be handled under the laws of California. If a lawsuit is filed, it must be brought in a court in California, whether it is state or federal. Both sides agree to the authority of those courts.

When a dispute is brought under this agreement, the side that wins may ask to get back its reasonable lawyer fees and the costs of the case from the other side.

10. Data Privacy And Security

Nexora Hosts gathers information about properties, booking activity, payments, and guest contact details. We use these items to keep the service running.

We put safeguards in place that are typical for this kind of service. These steps are meant to lower the risk of people getting into your data without permission.

We do not give your information to outside businesses for their own use.

Some parts of your data may be shared with outside partners. These partners help us with booking tasks, payment handling, or tools that connect platforms. We only share what is needed to finish a specific step and deliver what you asked for.

You can also ask to see what we hold about you, fix it, or remove it. For more information, review our Privacy Policy.

11. Modifications To Services

Nexora Hosts might adjust, stop, or close some services. Before we do, we will send you a written notice at least 30 days ahead. These updates can impact the pricing tools, guest screening steps, cleaning schedules, or the systems we use to connect to other platforms. If a change is a big one, we will spell out what it means for your property before it starts.

If you do not agree with a significant change, you can end this agreement during the notice period. You can do this under Section 6, and you will not face a penalty. If you keep using the services after the change begins, you are saying you accept it.

12. Entire Agreements And Order Of Preference

These Terms and Conditions, along with your signed management agreement and our Privacy Policy, are the full agreement between you and Nexora Hosts. They take the place of any earlier talks, proposals, quotes, or statements about the same topic.

If there is a clash between your management agreement and these terms, the management agreement will be used. If these Terms and the Privacy Policy disagree on how personal data is handled, the Privacy Policy will be used.

13. Severability

If any part of these Terms is found to be unenforceable, that part will be limited or removed to the smallest extent necessary, and the rest of the agreement stays in full effect.

14. Assignments

You cannot hand over this agreement to another person unless we agree in writing. We will not block that approval without a fair reason.

If you decide to sell the property, the buyer does not get this agreement by default. Please reach out to us first, and we will set up a fresh agreement for them.

Nexora Hosts can move this agreement to a new company if the business is merged, bought, or sold. If that happens, we will let you know.

15. Notices

Send notice to Nexora Hosts at Nexorahosts@gmail.com. Send notice to us at the email address you used when you signed your management agreement.

Email notice counts as received on the next business day after you send it.

This agreement only accepts notice sent by email to the email address listed above. A phone call, a text message, or a message on social media is not noticed under this agreement.

Since email is the only method, each side must keep an active email address on file and check it. Tell us in writing if your email address changes.

If an email notice comes back as undeliverable, the sender will try again one more time. After that second attempt, the notice may be treated as delivered.

16. Force Majeure

No party is at fault for not doing its duties if the reason is beyond its reasonable control. Examples are events like storms, fires, floods, earthquakes, harsh weather, war, unrest, government actions or limits, public health emergencies, power or internet problems, and issues with a booking site or its system being down.

If an event like this stops performance for over 60 days in a row, either party can end this agreement by sending written notice. There will be no fee or penalty for doing so.
